MEETING OF THE SELECTMEN

Selectmen present: Rick Chellman and Bill Stockman. Absent Susan Weeks.

Vouchers for payment were reviewed and signed.

Selectmen reviewed mail which included: treasurer’s reports for July; complaint re: the DeVere’s wood boiler; groundwater monitoring results; draft petition for highway dedication and acceptance; letter re: septage lagoon closure plan; fuel usage for July; Police Dept. fuel usage and mileage for July; updated inventory for the Tuftonboro Free Library; copy of letter of complaint to Adelphia Cable; Site Visit report by Rudolph Cartier of DES; request for funding for 2002 from Tri-County Community Action; building permit for William & Carolyn Wood; payment from Jenness Metals in the amount of $53.20; wetlands permit for Michael Robinette; DES letter of deficiency for Mr. & Mrs. Randy Parker; property transfers for Tuftonboro Land Trust to Joseph D’Alessandro and Alexander Pitcairn to Vicki Colcord; and transfer station/recycling center fees & permits.

At approximately 6:45 PM, the Board met with Joan Theve who represents the Town on the Transportation Technical Advisory Committee. Mrs. Theve updated the Selectmen on the Committee’s work and told the Selectmen that Greg Tansley of L.R. Planning Commission would be contacting the Selectmen to make sure all Town roads are being accounted for. The Committee will meet again on Sept. 5th to go over the Enhancement project applications. Chairman Chellman told Mrs. Theve that the Selectmen will be writing a letter to Ossipee, Moultonborough and Wolfeboro to try to gather support for the reconstruction of Routes 109 and 171. The Selectmen will provide a copy of the letter to Mrs. Theve to take to the September 5th meeting, if it is completed by that time.

A motion was made by Bill Stockman to appoint Barbara Wood as a member of the Planning Board to take Susan Weeks position. Rick Chellman seconded the motion. All in favor.

The letter for the Dept. of Revenue Administration was reviewed and revised. The letter will be faxed tomorrow.

The Board approved the supplemental agreement with Dufrense-Henry for $1,000.00 to cover the costs of testing the clay samples.

Rick Chellman may not be at the meeting next week, August 27th. May need to reschedule the trip to Abenaki Hill Estates.

The Selectmen briefly discussed the issue of relocating the septage lagoons and the charging of fees for dumping. The Selectmen may try to meet with septage haulers and Recycling Center Staff on September 10th to discuss the proposed fees. A final date will be decided next week.

A motion was made by Bill Stockman to accept the minutes of the August 13, 2001 meeting. Rick Chellman seconded the motion. All in favor.

Chairman Chellman spoke to Attorney Sharon Cuddy-Somers re: the cable negotiations. The Town will stick with the 10-year contract term unless Adelphia has something to offer the Town for a longer term.

The Board met briefly with Police Chief Andrew Shagoury. Chief Shagoury related that things have been quieter. The Department is now fully staffed, so the Department is able to have more hours during the day out on patrol.

The Conservation Commission will be asked to look into the construction of a stonewall in the water on a property off of Lake Road.

The Selectmen and the Road Agent traveled on Shirley Way and Woodland Drive to look at the work that has been completed by the residents of these roads. The Selectmen also stopped at 19-mile beach to view the completed construction of the beach.

At approximately 7:30 PM, the Selectmen met with Conservation Commission Chairperson Ann Hackl. Mrs. Hackl was interested in having a warrant article before the Town this year to designate all or a portion of the Land Use Change Tax to the Conservation Fund. After a lengthy discussion and review of the RSA’s the Selectmen will discuss again at their meeting on September 10th.

The Selectmen opened the sealed bids for the 1995 Ford Crown Victoria police cruiser. The bids were as follows:

A motion was made by Susan Weeks to accept the bid of Charles LaMonica in the amount of $3,757.00. Bill Stockman seconded the motion. All in favor.

The Selectmen will send a notice to the local septage haulers and the Recycling Center staff regarding a meeting on Monday, September 17th to discuss charging for septage disposal.

Chairman Rick Chellman will draft a letter to the Towns of Ossipee, Moultonborough and Wolfeboro re: Routes 109 and 171. Selectmen Weeks and Selectmen Stockman gave Chairman Chellman permission to sign the letter on their behalf. A copy of the letter will be sent Joan Theve.

Chief Shagoury updated the Selectmen on the following:

bulletOfficer Hathcock will be teaching a Women’s Safety Class on Tuesday, August 28th in Wolfeboro.
bulletThe Police Dept. will be offering a Less Lethal training class on September 11th & 12th.
bulletOpen House on Saturday, August 25th for Police canine went well.

The Town will look into putting some high intensity lights around the Town Office.

At approximately 6:30 PM, the Selectmen met with Fire Chief Adam Thompson. Chief Thompson updated the Selectmen on the following:

bulletMinor accident with Engine 3. Statement provided to the Selectmen. Fuel shed hit, minor damage to both the truck and the shed. The Selectmen will have Road Agent Reg Colby take a look at the shed.
bulletDiscussion regarding the money placed in capital reserve this year and what it can be used for.
bulletProper steps outlined by the NH Attorney General’s Office have been completed to successfully dissolve the Firefighters Association Relief Fund. The money in this fund will be transferred to the Firefighters Association fund. Once the transfer is complete, the Association will have approximately $90,000 in the Association fund.
bulletChief Thompson received a letter from Linda DeVere asking what date was reasonable to start her wood boiler. All information concerning this issue will be sent to Attorney Sullivan for review.
bulletThe Department will be doing Fire Prevention in the schools in October.
bulletAll apparatus is under going seasonal maint.
bulletChief Thompson will be attending a media communication course on Sept. 19th.

Selectman Weeks will contact Attorney Sullivan regarding the purchase & sales agreement for Fred Sargent’s land. The agreement will give authorization to do the survey. Contact Tom Sweeney to let him know it will be a couple of weeks before the survey can be done.

The Selectmen reviewed the letter sent by Attorney Sharon Cuddy Somers regarding the cable contract. Selectman Weeks outlined her specific questions. Chairman Chellman will contact Attorney Somers to get questions answered, get a copy of the Adelphia map and to give her authority to move ahead with the negotiations.

At approximately 7:30 PM, the Selectmen met with Tim Hallam and his wife. Mr. Hallam told the Selectmen that the day Dame Road was paved in the middle of August, his wife called him at work and said that the "whole house was shaking, the water has turned brown and was not getting very much water out". Mr. Hallam said he instructed his wife to turn the well pump off. Mr. Hallam told the Selectmen that he has a 9-foot deep dug well, which is approximately 35 feet from the road. Mr. Hallam has lived at this location for many years and has never run out of water. The Hallam’s had Jeff Moody dig a new well for him, which about 3 feet from the other well and about 3 feet deeper than his old well. He currently is getting 4 gallons per minute. Mr. Hallam also told the Selectmen that Dick Mullen at 121 Dame Road had problems with is 100 ft. drilled well. Mr. Mullen had to repair some pressure gauges, the water was brown and he had limited water for a time. Mr. Hallam would like to see the Town compensate his family someway. Mr. Hallam stated that he has already contacted Pike Industries who were unresponsive. The estimate for the new well is $1,300.00. The Selectmen said they would talk to Pike Industries and the Town’s insurance agent re: the situation. They will get back in touch with Mr. Hallam.

The Selectmen reviewed the Steve Mitchell issue on Willand Road. Since a lien is already in place on the property, the Selectmen will accept payment for the taxes owed on the mobile home for 2 ½ years and hold the check until the end of September when Mr. Mitchell can cash his check for the payment of the mobile home. The mobile home is scheduled to be removed on Thursday, September 13th. Tax Collector Jackie Rollins will prepare a letter stating the taxes have been paid.

Susan Weeks made a motion to accept the minutes of the August 20th and 27th Selectmen’s meeting. Bill Stockman seconded the motion. All in favor.

After further discussion, the Selectmen agreed to include a warrant article for next year to have 50% of the Use Change Tax-with a cap of $5,000 deposited into the Conservation Fund each year. Selectman Weeks is generally not in favor of discretionary funds and felt that if the Conservation Commission had a specific request it should be included in the budget. The Town will check with Attorney Sullivan regarding the RSA’s which indicates that a ballot vote must occur for this warrant article, but not on the official ballot.

Police Chief Andrew Shagoury told the Selectmen that the Website for the Town is coming along well. The motor vehicle activity for this year currently exceeds the total numbers for 2000. On October 20th, Chief Shagoury and Koda will be participating in a Lakes Region Humane Society event at the Castle in Clouds.

The Parents of the Tuftonboro Central School 4th graders requested the use of the Davis field for a fundraising event on September 22nd. Selectmen approved this activity.

The Selectmen discussed the observations they made on August 27th during their visit to review the work done on the Abenaki Hill Estates Roads. The Selectmen noted the following:

bulletThe pavement in front of Lot 16 on Woodland Drive has been cut and removed.
bulletConcerns about the ditching in front of Lot 9 and whether it is deep enough to deal with a water problem.
bulletCulverts were installed in front of Lot 24.
bullet5 test pits were video taped but not all witnessed by an engineer as requested.
bulletDitches shaped up by Lot 12.
bulletCleaned out brush on the sides of the road and reshaped those areas requested.

Chairman Chellman will review the video again this week.

At approximately 6:30 PM, the Board of Selectmen met with Fred Sargent and John Lewis from the Tuftonboro Recycling Center and Transfer Station regarding the disposal of septage. Mr. Lewis provided the Selectmen with a list of fees charged at area Centers. Mr. Lewis reported that as of 9-11-01, 300,250 gallons of septage had been dumped this year in the Town’s septage lagoons. The haulers, D.J.’s Septic and Lakes Region Septic reported the waste came from 261 tanks. Selectmen Stockman felt that a reasonable rate should be charged so that people would keep their systems in good working order. After some discussion, the Recycling Center/Transfer Station staff and the Board of Selectmen felt that a reasonable fee for septage disposal would be $50.00 per 1,000 gallons. The Staff also discussed a billing system and the need for numbered invoices.

The Selectmen met briefly with Fire Chief Adam Thompson. The Chief updated the Selectmen on the following:

bulletProvided a letter from Richard Friedman re: the plowing of North Line Road and the care of his elderly mother at this residence. This will be discussed with Road Agent Reg Colby.
bulletFour Firefighters have recently completed EMT classes and will complete the testing next month. Four more Firefighters are interested in the next set of classes.
bulletThe Department has been trying to obtain budget figures for the removal of the hose tower. Still need an estimate from a carpenter.
bulletThe Department has had 132 fire calls and 90 medical calls so far this year.

The Selectmen reviewed Chief Thompson’s 2001 budget with him. The line item for Firefighters allowance has been over expended due to the number of calls and the addition of more men. Chief Thompson believes he can remain within his bottom line from money saved in the equipment line item and vehicle maintenance.

At approximately 7:10 PM, the Selectmen met with the Recycling Center/Transfer Station Staff, Dave Joubert of D.J.’s Septic and Bob Lineham of Lakes Region Septic.

Mr. Joubert and Mr. Lineham provided the Selectmen with some helpful information. They felt the fee of $50.00 per 1,000 gallons was reasonable. Mr. Joubert said he would like to see the fees collected put back into the maintenance of the lagoons. Mr. Lineham told the Selectmen that in Wakefield, they work on an honor system. The two haulers permitted to use the Wakefield facility both have keys and can dump 7 days a week. Mr. Joubert told the Selectmen that it costs about $12,000 to $15,000 a year to maintain his private septage lagoons. Both haulers felt a monthly billing system would work best. A motion was made by Susan Weeks to begin charging $50.00 per 1,000 gallons for septage once the new lagoons have been constructed next year. Bill Stockman seconded the motion. All in favor.

At approximately 7:30 PM, the Selectmen met with Paul Knight who will be working on a Cost of Community Services study for the Town. This study gives a financial analysis in a given year using expense and revenues in the budget assigned proportionately to land use categories. The Selectmen were interested in knowing how the land use categories would be defined and the allocations. Mr. Knight should have the study completed in 2 ½ to 3 months. The Selectmen reviewed copies of the Cost of Community Services studies completed for the Towns of Meredith and Alton. The Town of Ossipee is currently working on a Cost of Community Services study. Mr. Knight told the Selectmen if they have any suggestions or things they would like him to do, to please contact him. Chairman Chellman asked that Mr. Knight provide the Board with the allocation information. Mr. Knight made the suggestion that the Town contact White Mountain Resource Management Inc. regarding the Town’s sludge.

A motion was made by Rick Chellman to move into non-public session pursuant to RSA 91-A: 3, II (c). Sue Weeks seconded the motion. All in favor. Roll call: Selectmen Stockman – yes, Selectman Weeks – yes and Chairman Chellman – yes.

A motion was made by Rick Chellman to move back into public session. Sue Weeks seconded the motion. All in favor.

Code Officer Dave Senecal reported to the Selectmen that to date he has issued 100 building permits, 22 permits for new homes, 14 plumbing permits, 30 electrical permits, 14 occupancy permits and 1 sign permit. Residents of Edge-O-Lake have replaced at least 5 or 6 mobile homes. The Edge-O-Lake Association will be looking to upgrade electrical/phone lines in the next 4 to 6 years. Things have been busy.

Mr. Senecal told the Selectmen he received a copy of the letter from Linda DeVere.

The Selectmen said they would be responding and read a draft of the letter. The Board of Selectmen all agreed it was appropriate. Legal counsel will review the letter.

At 8:05 PM, the Selectmen met with Ted Bense regarding the Household Hazardous Waste Collection and the 19-mile beach. Mr. Bense told the Board that due to the huge success of the collection this year that the Lakes Region Planning Commission would be looking for Town’s to contribute at least $3,000 next year, up from $1,378. The study group Mr. Bense is part of is also looking at a collection site in Wolfeboro and offering 6 collection days, however the cost would be about $7,000.

Mr. Bense provided a plan for the proposed pavilion at 19-mile beach. The structure is 24 X 32 and would house either bathrooms or chemical toilets. Mr. Bense provided estimates for the construction as well as an estimated cost for the relocation of the utility lines. The Beach Committee is still in the planning stages regarding the utility lines and the fence issue. The Board and Mr. Bense discussed these issues. Resident Mr. Laase asked that the Town abide by the Shoreland Protection Act and use caution regarding the installation of a well, as Mr. Laase’s well is contaminated. The Selectmen said they would abide by the Shoreland Protection Act.

The Selectmen reviewed the legal correspondences from Attorney Somers. The Selectmen will review in more detail and then get back to Attorney Somers tomorrow.

Chairman Chellman has completed the cremation plot plan.

A motion was made by Sue Weeks to accept the minutes of September 10, 2001 with the proposed modifications. Bill Stockman seconded the motion. All in favor.

The new Highway Truck will be delivered at the end of next week. The Selectmen need to decide next week which warranty they would like to purchase. The truck will need to be lettered and a radio installed.

The Selectmen asked if Road Agent Reg Colby could patch Ledge Hill Road where the culvert was replaced as soon as possible.

Selectmen Stockman will take a look at the boat ramp on Lake Road and review the permit from the State.

Selectmen Weeks will attend the meeting with the Department of Revenue Administration to set the tax rate on Thursday, September 20th at 9:00 AM.

Chairman Chellman will not be at next week’s meeting as he will be out of town.

The Administrative Assistant will contact Jack Robertson regarding the cost of living percentage for this year.

At approximately 6:30 PM, the Selectmen met with Fire Chief Adam Thompson. Chief Thompson recommended the appointment of Wesley Smallidge as a Firefighter for the Department. As with all new firefighters, Mr. Smallidge will be put on a one-year probation period. A motion was made by Bill Stockman to appoint Wesley Smallidge as a firefighter based on the recommendation of Chief Thompson. Sue Weeks seconded the motion. All in favor. The Department has grown from 13 members in January of 2001to 19 members currently.

The Selectmen reviewed the purchase and sales agreement drafted by Attorney Sullivan for the purchase of land owned by Fred Sargent, which abuts the landfill. The agreement will be given to Mr. Sargent for review and his signature.

The Selectmen reviewed the final draft of the Adelphia cable contract. Selectman Weeks is still having trouble with the paragraph on page 9, she feels the word "are" should be inserted. This issue will be brought to Attorney Somers attention.

A motion was made by Sue Weeks to accept the minutes of the September 17, 2001 minutes. Bill Stockman seconded the motion. All in favor.

Bill Stockman inspected the boat ramp on Lake Road. He felt that the ramp itself was in good shape and made some suggestions as to other things, which could be done to keep people from backing off the side of the ramp. The Selectmen will discuss this issue with Rick Chellman next week.

Another memo will be sent to the Conservation Commission re: the breakwater at the end of Lake Road.

Linda DeVere has requested under the Right to Know law, copies of everything the Town, Selectmen, Police Dept., Fire Dept., and Code Officer have regarding her wood boiler. The Selectmen asked that once again everything in the Town’s files be sent to Linda DeVere, even though everything has already been forwarded to her.

Resident John Galvin expressed his concern regarding the number of pallets at the DeVere home. Concerned about infringing on the Town right of way and a potential fire hazard.

The Selectmen reviewed and gave their input regarding the lettering design for the new highway truck.

The Board asked that a budget schedule be prepared for the Selectmen to meet with the various departments to discuss their budgets.

The Selectmen asked Chief Shagoury how the letter received from Sheriff Carr would effect the Department. Chief Shagoury does not feel it will have an impact on his Department. The Town’s website is almost complete and Ms. Herder hopes to have it on-line later this week.

Bob Theve expressed his interest in serving on the Planning Board and helping out in any way he can. The Board thanked him for his interest.

Selectman Weeks expressed concern with a couple of building permits and asked that this information be passed onto Code Officer Dave Senecal.

bulletThe Selectmen asked that the Town of Ossipee be notified that they would be interested in attending the one-day meeting of the Carroll County Selectmen. The Selectmen would like the Dept. of Transportation to be invited to the meeting.
bulletChairman Chellman will look at Thomas Point Road.
bulletThe Town is still waiting for the bill from Tim Hallam re: his well.
bulletSelectmen Stockman discussed his findings about the Lake Road boat ramp. Mr. Stockman felt that a curb material on either side of the ramp, posts on either side of the ramp at the beginning and some crushed stone on the sides might help. The ramp itself is in good shape. Selectmen Stockman will speak to Road Agent Reg Colby.
bulletThe Selectmen asked that a note be included on future agendas under the appointments, which states "In order only. Times are approximate."
bulletThe Board asked that Melcher and Prescott be contacted for a quote on health insurance in response to their letter.
bulletThe Selectmen approved the letter to be sent to Linda DeVere with the attached documents.

At approximately 7:00 PM, the Board met with Joan Theve, the Town’s representative on the Transportation Advisory Committee. Mrs. Theve updated the Selectmen on the various transportation enhancement projects. A public hearing will be held on Wednesday, October 3rd in Wolfeboro and Laconia re: the proposed DOT-10-year plan. Mrs. Theve will attend the meeting on October 3rd.

At approximately 7:30 PM, the Selectmen met with Code Officer Dave Senecal re: a building permit issued to Walter Eberhardt of 16 Shady Lane, Edge-O-Lake. Mr. Senecal told the Board that Mr. Eberhardt spoke to the Edge-O-Lake Association when he ordered his new mobile home. The NH Electric Cooperative became involved when the proposed home was going to be in the electric companies easement. Mr. Senecal met with the NH Electric Cooperative, the property owner and abutters to Mr. Eberhardt. Mr. Eberhardt agreed to pay to move the electrical lines. The easement to the NH Electric Cooperative was to be handled by the parties attorneys however, the Association refused to grant an easement over their common property. Mr. Senecal said that Mr. Eberhardt has a variance, which was granted on May 12, 1988, however the variance was not specific with setback dimensions. If the mobile home was 56 feet there would be no problem, however Mr. Eberhardt insists on having a 60-foot home. Mr. Senecal said he never knew that Edge-O-Lake was condominiumzed and had never seen the new plan of Edge-O-Lake. Selectman Weeks asked if he requires scaled drawings. Mr. Senecal told the Board that he didn’t pay enough attention to this issue. This morning Mr. Senecal found out that Mr. Eberhardt has stopped doing anything with his lot and is going to sell it. Mr. Eberhardt has also threatened to sue the Association. Mr. Senecal will talk to Attorney Sullivan when he returns from vacation to see if the Town should rescind the building permit. The Selectmen suggested Mr. Senecal require scaled drawings.

Selectman Weeks questioned Mr. Senecal about a permit that was issued for a boathouse, which was not at the waters edge, or did not have water underneath of it. Mr. Senecal told the Board his interpretation of the ordinance. Mr. Senecal suggested the Planning Board rewrite this section of the ordinance. The Selectmen did not agree with Mr. Senecal’s interpretation. Mr. Senecal said he would not issue any other permits such as this.

The Selectmen suggested that Mr. Senecal meet with the Board on a monthly basis to review permits, discuss problems etc. This monthly meeting will be scheduled with the Administrative Assistant.

Mr. Senecal told the Selectmen that in the next 3-5 years, the Town would need to think about a vehicle for travel and making the position full-time. Mr. Senecal would like to get a computer for next year, as many resources are on-line or available on CD-ROM.

At approximately 8:00 PM, the Selectmen met with Police Chief Andrew Shagoury. The Board briefly discussed conversations with Attorney Somers re: indemnification of Town officials. Chairman Chellman stated for the record that after reading the NH Sunday News and in meeting with Mr. DeVere on several occasions, he is yet to see a scintilla of evidence that supports Mr. DeVere’s allegations. If there was this Board would be doing what he claims he is doing, investigating. Chairman Chellman stated that he has only seen the highest level of professionalism by Chief Shagoury and his officers. He said he does not have even the smallest criticism. Selectman Weeks and Selectman Stockman agreed with all of Chairman Chellman’s remarks. Mr. DeVere has been to the Board of Selectmen, he has showed no evidence and he has been told there is no problem with the Police Department. Chairman Chellman stated that Chief Shagoury and his family have the support of the Town.

Chief Shagoury updated the Selectmen on the following:

bulletThings have been busy and investigations have increased.
bulletOfficer Mullen is doing a great job.
bulletMotor vehicle stops are very high this year so far.
bulletThe Department has responded to minor criminal activity including vandalism, paint balls shot at the school etc.
bulletThe Attorney General has issued information regarding suspected terrorism and hate crimes. The NH Attorney General’s office has created a task force on terrorism. A list of locations in the state, which store explosives, was provided to every town. Chief Shagoury has identified 25 potential targets in town.
bulletChief Shagoury has been elected the Vice President of the Carroll County Chief’s Association.
bulletChief Shagoury attended training on Sept. 27th at Pease re: management for small rural police departments.
bulletTrick-o-treat will be Oct. 31st from 5:00 PM to 7:00 PM. The Dept. plans on handing out treats at the office.
bulletThis spring the Dept. will have a law enforcement day and the bike rodeo.
bulletThe regional grant for extra patrols and education re: underage drinking was approved.
bulletChief Shagoury has been visiting the school, having lunch with the kids and spending time with them at recess.

Selectmen Weeks made the suggestion that perhaps the school kids could visit the town beach during bike rodeo and/or help with maintenance/clean up at the beach. Selectmen Weeks feels it is important to teach kids to take pride in public property, so they will not deface it.

Chairman Chellman said he is very interested in trying to develop a multi-use trail system in town. The trails could link to places such as the beach. Sue Weeks suggested speaking to Ken Cookson as he attended the scenic by-ways meetings for many years. The Selectmen will look to meet with Mr. Cookson and one person from the Conservation Committee in the beginning of November.

The Selectmen reviewed the information from Arthur Morrill regarding a use change penalty. Mr. Morrill has provided a figure for what he feels the land is valued. The Selectmen asked that the property owners be contacted to find out their particular plans for construction.

The Abenaki Hill Estates road issue will be discussed at the October 15th meeting.

A motion was made by Sue Weeks to move into non-public session pursuant to RSA 91-A: 3, II (a) re: a personnel issue. Rick Chellman seconded the motion. All in favor. Roll call: Chairman Chellman – yes, Selectman Stockman – yes, and Selectman Weeks- yes.

Selectman Sue Weeks and Administrative Assistant will be attending the NH Municipal Association conference on Thursday, November 1st. Gigi Jackson will work on Thursday to cover the Administrative Assistant.

At approximately 6:30 PM, the Selectmen met with Library Trustees Patty Osmond and Carolyn Sundquist. The library is requesting $81,729 for the 2002 budget. This is an increase from $69,379 appropriated last year. These figures represent the benefits for library employees, which are separated into another appropriation (4155 Personnel Administration). The increase is due to an increase in salaries and benefits. The health insurance has increased 27.5% and the library will be adding dental for the librarians. The Selectmen discussed the outside maint. which is in the government buildings budget, which is above and beyond what the library budgets and the energy survey the library had the NH Electric Cooperative conduct. Selectmen Weeks will look into the energy survey. The Town will include the libraries bookmarks in the tax bills, which will be sent out the end of October.

Attorney Sullivan will be making some adjustments to the Fred Sargent purchase & sale and will send out the revised copy.

At approximately 7:20 PM, the Selectmen met with Bill Kaiser. Mr. Kaiser told the Selectmen that he would be interested in working on a committee to run the public access channel. Mr. Kaiser told the Board that it cost about $16,000 for the Town where he use to live to set up the equipment, cameras, editing equipment and 24 hours on-line computer for the access channel. He said he is willing to be part of the committee. The Selectmen suggested having some teachers in town be on the committee as well. The Selectmen thanked Mr. Kaiser for his interest.

Mr. Kaiser also asked why the Town of Tuftonboro is not listed as a member of the Coalition Communities. Twenty-seven towns are listed, but not Tuftonboro. Mr. Kaiser feels that Tuftonboro should belong to the coalition and that the Town should put some money into the budget next year to help the coalition communities fight the statewide property tax. Mr. Kaiser will check into what is involved in order to be a coalition community.

The Selectmen will be looking to appoint someone to the Budge Committee to replace Selectman Weeks.

The Selectmen will be meeting with the Fire Department on October 22nd at 6:30 PM and the Police Dept. at 7:45 PM to discuss their budgets.

Chief Shagoury updated the Selectmen on the following:

bulletPresented statistics for the month of September and police log.
bulletAttended a meeting of the NH Association for Chiefs of Police last week. The Governor and U.S. Attorney addressed the group speaking about the events of September 11th and how the State is preparing to handle terrorism and biochemical warfare.
bulletThe Chief will be attending a training on Wednesday and Thursday of this week on Weapons of Mass Destruction.
bulletHalloween trick or treat hours will be on Wednesday, October 31st from 5:00 PM to 7:00 PM. The Library will be having their haunted trail on Friday, October 26th.

Resident John Galvin said that he is still not seeing Police cruisers in Melvin Village. He would like to see more exposure, especially in the early morning hours and the evening hours. Mr. Galvin stated that a police presence is a deterrent to crime. Selectman Weeks said that Chief Berry use to make it a point to travel every road in Town on his shift and it seemed to make residents feel better to see the cruiser driving by, especially the older people.

Selectman Weeks suggested that the Selectmen do an annual inspection of all the Town buildings. This would help to identify problems so they can be budgeted. Selectmen Weeks and Stockman said that either early in the morning or late afternoon would be best. This issue will be discussed with Chairman Chellman for scheduling.

Selectman Stockman spoke to Ivan Phelps about the Melvin Village boat ramp. Mr. Phelps suggested that Road Agent Reg Colby, Selectman Stockman and Mr. Phelps travel to Center Harbor to see how the boat ramps were done. Selectman Stockman will talk to Mr. Colby.

The Administrative Assistant discussed the issue of a diesel tank at the Highway Garage for the new Highway truck. Wolfeboro Oil will be contacted for a price.

Selectman Weeks made a motion to grant the right of way requested by Pak 2000 for access to monitoring wells. Bill Stockman seconded the motion. All in favor.

The Selectmen reviewed the bill submitted by Tim Hallam for the damage to his well. The original figure provided by Mr. Hallam was $1,300.00; the bill submitted requested $2,003.00. The Selectmen discussed abating Mr. Hallam’s taxes. The Board will discuss with Chairman Chellman next week.

The Selectmen reviewed the contract with Rick Van de Poll for his ecological inventory of the Great Meadows. The Conservation Commission received a grant from LCHIP to hire Mr. Van de Poll to complete this inventory. Mr. Van de Poll has already begun his work, however the grant money has not been received. The Selectmen spoke to Conservation Commission Chairperson Ann Hackl regarding this issue. Mrs. Hackl will find out when the grant will be issued. The first payment due to Mr. Van de Poll of $2,500.00 will be paid out of the Conservation Fund. When the LCHIP grant is received it will be placed in the Conservation Fund. The Selectmen were uncomfortable signing the agreement, until they knew the money was coming.

Selectman Stockman said that Ann Hackl expressed some concern that she was not notified in writing about the Board’s decision on the use change penalty. The Selectmen will send Mrs. Hackl a copy of the minutes.

Sue Weeks made a motion to accept the minutes of the September 24th and the October 1st meetings with the proposed amendments. Bill Stockman seconded the motion. All in favor.

Rick Chellman requested that the meeting for next week be moved from Monday, October 29th to Tuesday, October 30th. The Selectmen would also like to meet with Attorney Sullivan and Dave Senecal. Chairman Chellman will confirm this change tomorrow with the Administrative Assistant.

At approximately 6:30 PM, the Selectmen met with the Fire Chief Adam Thompson, Deputy Fire Chief Rich Piper and Lt. Butch Gagne regarding the Fire Department budget for next year. Chief Thompson reviewed the Department’s proposal. The most significant increases were in the station maintenance due to the repair of the hose tower and replacement of some windows. The other increased costs were for the firefighters pay, the Deputy Chief and Officers pay, and addition of the Fire Chief as a full-time position. The Selectmen supported the full-time position of Fire Chief and worked with Chief Thompson, Deputy Chief Piper and Lt. Gagne to get the best budget numbers to present to the budget committee. The following changes were made:

bulletThe station maintenance costs of $9,000 will be moved into Government Buildings.
bulletFire calls and medical calls were adjusted slightly for the Firefighters and Officers resulting in a decrease from $43,448.50 to $34,051.00.
bulletThe proposed total budget amount for the Fire Dept. $144,663.00.

The Administrative Assistant will prepare the Departments budget in the Town’s budget format for Chief Thompson and the Dept.’s review.

At approximately 7:30 PM, the Selectmen met with Police Chief Andrew Shagoury regarding his budget requests for 2002. Increases in the budget come from the step increases in the salaries for the Chief and the Officers, as well as having the Administrative Assistant for a whole year. After much discussion, the Police Dept. was adjusted with the following changes:

bulletEliminate the request for a part-time officer in the amount of $6,240.00.
bulletSubtract $1,300 from Uniforms for a part-time officer and $500 from conference & trainings.
bulletThe proposed total budget amount for the Police Dept. $164,505.00

Chief Shagoury updated the Selectmen on the following:

bulletChief Shagoury completed a two-day training on Mass Destruction.
bulletThe Chief and K-9 dog, Koda did a demonstration for the Police Explorers in Gilmanton.
bulletThe Police Dept. has Trick-o-treat bags for Halloween.
bulletOfficer Hathcock will be attending a Private Security liaison training.
bulletOfficer Mullen will be attending a Domestic Violence training.
bulletThe motions filed by Peter DeVere were denied.

The Selectmen discussed the following items:

bulletThe Planning Board has invited the Board of Selectmen to a presentation by the Lakes Region Planning Commission on December 6th.
bulletThe letter from the LCHIP grant was reviewed. The Selectmen do not feel that a Selectmen’s signature needs to be on the contract with Ecosystems Management Consultants.
bulletInspections of the Town buildings will begin with the Highway garage on November 5th at 7:30 AM, if Road Agent Reg Colby is available.
bulletThe Town will pay $1,300 to the Hallam’s for their well from the legal appropriation. Attorney Sullivan will draft a letter stating that the town is not accepting any liability for this issue.
bulletNew owners are moving into the Carroll’s house at the end of Sandstrom Road. The Selectmen approved the Road Agent working on the road to prepare for plowing this winter.
bulletSue and Rick Weeks will visit the library to look at the light issue.
bulletThe State Office of Public Health is requiring all hospitals to set up their own plan to deal with bio-terrorism. Huggins will be scheduling a meeting in the next couple of weeks.
bulletThe Recycling Center/Transfer Station will be closed on Sunday, November 11th for Veteran’s Day. The Town Office will be closed on Monday, November 12th.

Chairman Chellman will check with Attorney Sullivan whether the Selectmen can hold a meeting on the 11th.

bulletAbenaki Hill Estates will be discussed next week.
bulletThe Selectmen will discuss the diesel tank quote with Road Agent Reg Colby when they meet with him on November 5th.

At approximately 6:30 PM, the Board of Selectmen met with Attorney Tim Sullivan and Code Officer David Senecal. The Selectmen discussed the procedure that is followed by Mr. Senecal in issuing a building permit. The Selectmen and Mr. Senecal also discussed the letter from the Mirror Lake Protective Association regarding the Askew property. Attorney Sullivan feels that it is the applicant’s responsibility to provide Mr. Senecal with the proper materials for him to make an informed decision. If Mr. Senecal is unsure about the issuance of a permit, he should speak to others or ask for more spec
