Minutes for July 21, 2005 meeting

 

Tony, Sue, Wilson, John and Rick were present.

Minutes of July 7th were approved as written.

Tony asked that everyone review the proposed scope of work for Burnt Rock.

 

7:30PM

# 1 Pope & Thomas   Formal Application for a Boundary Line Adjustment. Caverly Point Rd.    Rick Sager presenting. Dana Pope present.  It would be an equal swap between Thomas and Pope, away from existing septic system. Motion made and accepted to accept application as complete. No abutters present. Sue did the checklist. Question? Where is Thomas septic? Back of their property away from Boundary line. Public input? None. Closed. Rick moves to approve plan. Wilson 2nd. All in favor. Plans signed. To be recorded.

 

# 2 Robert & Jean Grady  Church Lane. Formal application for a 3 lot subdivision. Nate Fogg from Land Tech presenting. Applicant has 6+ acres and wishes to subdivide into 3 lots with 2 acres each. Access is Church Lane a private road.  Application accepted as complete. Ronald Freese, Margaret Wood, Robert Elder and his son, abutters present. Mary Ann Murray, owner of Church Lane also present. State Subdivision approval has been received. Sue questioned now that there will be three lots does the road have to built to Town Standards? Ordinance says three lots or less and the lot with the house does have access off  GWH. It appears on the plan that the driveway for the Moraros lot is not entirely within the 50’ ROW. That should be cleared up, easement maybe or relocate the road, so that it does not become a problem in the future. Public hearing opened. Mr Elder would like to see his lot on the map? Wilson showed it to him on the tax map and explained that if he wants a plan he would have to hire a surveyor. Mr Feese is concerned about drainage, he is located below this property and when property was timbered a few years ago runoff came onto his property. Mary Ann Murray is concerned about the access through her property, she gave deeded access to Moraros but is not willing to keep doing it, and no one has asked for this particular subdivision. Church Lane is very narrow and does not need more traffic. Grady’s property does have access and frontage off GWH.

Rick was not clear about it, was it a planning board issue or only when lots are sold off? Planning Board issue.  Mr Freese and Margaret Wood are both still concerned about runoff and drainage. Would power company cut more trees when power is put in etc? Mrs Davies of Mirror Lake Association had a few questions: Is there access to Mirror Lake? No. If they bought a lot below them on the lake, could they then have access? Yes.

Checklist; Easements? Note # 2 . Would like a copy of the deed it is referring to. Wilson is concerned about the straight up driveways on the two new lots and runoff. Maybe a better plan for their drainage.

 

Issues; # 1 Drainage, landscaping, utilities # 2 Access, # 3 Location of existing driveway. Wilson made motion to visit site. John 2nd. All in favor. Tuesday 26th @ 5:00PM. Wilson moved to continue public hearing to August 18th. 2nd. All in favor. 1st on the agenda.

 

# 3 Mary Jane Sargent & Fred Sargent. Postponed.

 

# 4 Zadeda Farms  Formal application for 25 lot subdivision off Durgin Rd. Bob Varney of Walker & Varney presenting.  87.7 acre parcel wishes to divide into 25 lots. Barry Gier, engineer from TriTech also present. Property is also in Ossipee but this subdivision only in Tuftonboro. Does not have State subdivision approval. Minor wetlands with no mitigation necessary.

 

Rick felt there was no professional signatures or stamps on the plan and no soils data so should not accept application. Mr Gier stated that at this time they don’t sign the plan, they sign when it’s ready for approval. Rick made motion not to accept application. No 2nd. Motion failed. Wilson made motion to accept application. John 2nd. 4 in favor. 1 opposed. Abutters present: Lacesse, Donovan, McGoldrick and owner Dufrense. Wilson asked for shortcut through the plans. Dwyer, S 1 overall subdivision. S2  & S3  detail of the lot sizes. S4 & S5 State subdivision plans with septic and wells. C1 & C2 Drainage plan and grading for the project. C3 & C4 Construction documents for roadways and drainage. Wilson asked if this is all new road construction? It will be over some of the current roadway but all new. Gravel road. Sue, what is proposed is not what is currently out there? Correct. Wilson; Will need to have site specific permit. Yes.

 

C5 & C6 Plan profile for proposed Black Bear Run., horizontal and vertical drainage design.

 

C7 & C8 Construction detail.  Need a drainage report. Gier thought one had been filed. No.

 

Sue commented that abutters had been in to see the Selectmen about concerns on that property and so far it had not been good public relations. Move to open to public.

John Lacesse bought the 10 acre abutting property and was told when he bought it there would be a subdivision going in, he is not in favor of the 25 lots, not against subdividing but does not like the layout of the lots and thinks 25 is to many for that land. April 3, 2005 100’ of his stonewall was removed by the abutter, that has been taken care of, he just wants to make sure that anything that goes on is by the book! His land is now posted.

Bill Donovan: Concerns; View, does not want to see other house in his view. Buffer? Utility pole does not want to see them. Traffic on Durgin Road, could they bond the developer, in case of damage to Durgin Rd?  Cutting directly behind his house, how close can they cut to a boundary? Home styles? No “cookie cutter” houses. Opposed to the project.

Jim McGoldrick: Lives in one of the “cookie cutter’ houses further down. Agrees with Donovan. Concerned with the long narrow lots, internal straight roads, speed is always a factor. Is not opposed to subdivision as long as it is done right. McGoldrick wanted to know if they were aware of the new large beaver pond out there?

 

Sue; It looks like wetland crossing and would need State approval.

 

Tony read letter from abutter Chiappizzi. His concerns: Fiscal impact on Town services. Fiscal impact on education. Fiscal impact on Durgin Rd. Current defunct large subdivisions in Town. Quality of life for Tuftonboro Corner residents. Traffic increase. Letter filed.

 

800’ road to cul de sac was questioned. Varney; they would have to ask for a waiver. Lacesse, did not like the look of the subdivision couldn’t they maybe redo the roadway? Varney noted that a cistern will be on lot 1-35. Sue made motion to do a site visit. 2nd. All in favor. Monday August 15th @ 8:00AM. Applicant will bring reduced plans for all, roadway and lots will be staked out. Wilson; slopes? Gier, yes. Wilson wants the board to have a consultant to monitor construction etc. Covenants & Restrictions? Yes. Board will need to see them.

 

Rick made motion to continue to August 18th 2nd on the agenda. John 2nd. All in favor.
