Mr. Frago
read a lengthy statement about his concerns, in which he attempted to correct
statements made by Mrs. Jones at the last meeting which the Fragos considered
erroneous. Following his presentation, Mr. and Mrs. Frago left the meeting.
Mr. Meehan
asked for an update on the Wolfeboro
Effluent situation. Mike Phelps stated that he was informed by the DES that
they would make a decision by September 12 on the TCC appeal as to whether it
will be heard; a letter is expected.
Docket #07-21-WC has been
assigned to the TCC appeal. The Board feels that discrepancies in names on the
various applications need to be addressed. The TCC discussed making a request
for documentation showing that Wolfeboro is authorized as agent, or copy of
appointment of attorney in fact or agent in fact, since the applicant’s name is
not the owner’s name on the application. At present, Wolfeboro has a purchase
and sale agreement with Jean Whitten.
Mr. Meehan questions the accuracy
of the surveyor performed by Wolfeboro. He questions the descriptions of his
boundaries, as shown by the survey (August 10) compared to those in his deed.
The TCC recommends that all these issues need to be mentioned during a site
walk with the DES. Mr. Meehan says the road construction continues to encroach
on his land; when he points it out, they move it back in one place, but then
encroach on another. The TCC suggested to Mr. Meehan that he write to DES that the
survey is deficient, and not in accord with the facts of the deeds.
In the interest of clarifying
his boundaries, Mr. Meehan has hired a surveyor. He stated that in the early 1920s
there may have been a right of way through his land for Whitten, but it would have
been only a small logging road. Improving the road to the extent being done is
contrary to the original scope of the right of way, if any of the road is on
his property.
Town property sale
The Board of Selectmen presented the sale of two pieces
of Town property to the Conservation Commission for review and approval: a small
piece, .294 ac. in
Brower land
This 50 ac. piece next to Cheney Farm is in Current Use. Chairman
Phelps will inquire if the owners would consider selling the land to the Town, or
give an easement. It was suggested
that the Wolfeboro-Tuftonboro Land Bank be asked to sponsor appraisal of the property,
which was assessed at $242,000; owners are asking $525,000.
CEOP project- Community Environmental Outreach Program
Sponsored by the UNH Department of Natural Resources- UNH
Cooperative Extension, they are asking for project ideas. Among the Board’s
suggestions were a water depth marker on the bridge at 19 mile bay, and
possibly some project in Great Meadows.

Ted Gillum has sent a letter, as well as called, to urge the CC to join the association. Since the Mirror Lake Association is already a member of this organization, it was decided it would be redundant to join
