TOWN OF TUFTONBORO
Selectmen present: Rick Chellman, Susan Weeks and Bill Stockman.
Selectmen reviewed mail, which included: Building Permits for George & Karen Moran, Henry & Jeanne Jalbert; Plumbing Permit for Bill & Barbara Barton; Driveway Permit for Maryann Whisman; Approval for Operation for Peter Morrill; Approval for Subdivision for Carol/Theodore Bense; Amended Sate Education Tax Warrant for 2003; Councilor Ray Burton Summer Field Tour; Notification of State Fire Towers to be Honored; Thank You Letter to Police Dept.; Course completion for Chief Shagoury; Assessor’s Exchange; GWRSD Agenda; Tuftonboro Landfill Manufactured Topsoil Tests; Tim Sullivan letter re: conflict Code Officer/Planning Board Member; Mirror Lake Protective Association letter dated 8/18/03 re: Wolfeboro Scenic View Committee meeting.

Minutes: The minutes of the 8/11/03 meeting were approved as corrected. The minutes of the 8/11 non-public meeting were approved.
At approximately 6:30, Selectmen met with resident Joe Kowalski. Mr. Kowalski had several concerns regarding activity on two lots behind the Tuftonboro Colony Association. Mr. Kowalski advised that the Tuftonboro Colony Homeowners Association still exists, is legal and has never been dissolved. The rules and regulations are still in effect. Mr. Kowalski is concerned about the logging being done on two properties that abut the association and the fact that an easement may have been given to use as an access road to Butternut Lane and that the road may be damaged by the trucks. There is now a dirt road on the property. Chairman Chellman said that any violation of covenants is a private matter, not under the jurisdiction of the town. He also stated that the town now owns the roads so the Association has no say. An Intent to Cut was submitted to be signed tonight. Mr. Kowalski would like to know what is happening as it develops not after the fact. He will contact the landowner regarding the easement. Selectmen also discussed the EPA regulation of getting a permit if an acre or more of land will be disturbed. This is not an issue in this case, as that has not occurred. The Selectmen thanked Mr. Kowalski for his time.
At approximately 6:55, Selectmen met with Fire Chief Adam Thompson. Chief Thompson reported 119 fire, 55 medical and 12 service calls so far this year. The department has 19 members. Two members have resigned – Greenwaldt and Ladd. Two firefighters have completed Firefighter level A and will be moving on to level B. One firefighter has completed EMT class and 4 members have had Rapid Intervention Training. Chief Thompson investigated a question posed by the Williams’ in regard to the fire pond on their property. They wanted to know if it should be fenced in since a day

care will be built in the area. Chief Thompson, after checking the RSA’s, determined that a fence was not needed. Chief Thompson related the problem at the Recycling Center with the gas alarm. The alarm has been going off but when checked there are no high levels of gas in the building. It was felt this could be due to a combination of the weather, which has been very humid and the manufactured topsoil fumes. The Recycling Center does not have a Knox box, as do all the other Town buildings so the Chief will be looking into getting one. This will allow access (Fire Dept. only) to the building. Chief Thompson reported the next scheduled meeting of the smallpox team would be held at CAP in Tamworth on 8/21 at 9:30am. A rough draft of the procedure in how to notify the residents of Tuftonboro in the event of a disaster is needed for that meeting. Selectman Weeks asked the Chief to break down the mutual aid calls by town. It was also suggested to include the number of times Wolfeboro is called for mutual aid in Tuftonboro. The Selectmen thanked Chief Thompson for his time.
At approximately 7:15, Selectmen met with Police Chief Andy Shagoury. Chief Shagoury reported that Tom Lafvre has passed the last physical agility test in order to start the academy on the 25th. The Chief also advised that the department has gotten approval for a $5,000.00 homeland security grant. There are several things it can be used for including protective clothing and gear. There have been several requests for police details to install the cable. The charge to the cable company includes the use of a cruiser. Chip Joseph has been used on some of the details since he is still considered a part time employee. Other departments that work a detail for Tuftonboro bill the cable company directly. Chief Shagoury said that he has not pursued the 4th officer at this time as he is trying to get Mr. Lafvre set with uniforms and other necessary gear. The cruiser is still being worked on. The Selectmen thanked the Chief for his time.
The Selectmen discussed the appointment for the 911 ALI Database Liaison. Selectman Weeks felt it should be the responsibility of the Code Officer to issue the house number when a building permit is issued. Selectman Weeks will pursue this matter before signing the appointment.
At approximately 7:30, Selectmen met with Recycling Supervisor Fred Sargent. Mr. Sargent also spoke about the gas monitor and will pursue having the monitor checked and calibrated. Mr. Sargent reported that a hose blew on the compactor on Sunday. The new uniforms were delivered to the Town Office today. The Selectmen thanked Mr. Sargent for his time.
Chairman Chellman advised resident Richard Hastings that there is no requirement to notify abutters of a logging intent.
Mike Pod inquired about the status of the bond in the Beechwood Estates issue. Selectman Weeks advised that it is a mortgage held by the Town and since the requirements have not been met the Town had started the foreclosure process. The parties involved have met with the Selectmen and were given a six-month extension to come up with a plan so that the roads do not have to be built. They will then go to the

Planning Board and at that point all abutters will be notified. Selectman Weeks stated that if the parties are actively moving ahead it could be a longer extension of time.
Selectmen reviewed building permits with one being referred back to the Code Officer.
Selectman Weeks made a motion to appoint Ted Wright as Health Officer. Seconded by Selectman Stockman with all in favor.
Selectmen reviewed the abatement request by Walter Jamitkowski and the assessor’s recommendation to deny the request. The Selectmen voted to go with the assessor’s recommendation and denied the request.
Selectmen discussed the Intent to Cut as the logging started before the intent was signed. Selectman Stockman found out that only the forest ranger or the DRA could ask a logger to stop. The intent was signed without requiring a bond, which had been discussed briefly.
Selectman Weeks spoke to Town Counsel regarding the letter dated August 4th from the Mirror Lake Protective Association. The two letters will be faxed to Tim Sullivan. Selectman Weeks will check Mr. Libby’s will. Joe Lessard had been asked if there was any reason why a property in one town and owned by another town could not be taxed. Mr. Lessard thought there was no statutory reason it could not. Mr. Lessard will investigate further and get back to us. A response will be sent to the MLPA acknowledging receipt.
Selectmen discussed the County Road Bridge. It was decided to have Chairman Chellman speak to Ed Bergeron. The blueprints from Dopp & Dopp will be mailed to Mr. Bergeron for his review.
Selectmen briefly discussed the need to address the Recycling Center Site Review. It will be put on the agenda for next week. Waste Management will be contacted to see if they have anyone to do structural design.
At approximately 8:40, Selectman Stockman made a motion to go into non-public session pursuant to RSA 91-A: 3 II (c) to discuss a personnel issue. Selectman Weeks seconded the motion. Roll call: Chairman Chellman – yes, Selectman Weeks – yes, Selectman Stockman – yes.
